By performing any actions related to the use of the VIVOSOUND Service, including recording the application that is part of the Service in the memory of computer or telecommunications devices and starting using it, you confirm that you have carefully studied the text of the User Agreement and fully accept its terms. In case of disagreement with any of the terms of the User Agreement, further use of the Service is not allowed.

1. General provisions

1.1. The terms of this User Agreement, posted for review by any persons at www.vivosound.com, are a public offer. Beginning use of the Service means full agreement with the terms of the User Agreement and entails the conclusion of an agreement between the person who started such use (hereinafter referred to as the User) and VIVOSOUND (hereinafter referred to as the Service Administrator).

1.2. The User Agreement is an affiliation agreement and defines the terms and conditions for using the Service, including User registration for the purpose of using the Service’s functionality, as well as the rights and obligations of the Service Administrator.

1.3. The Service Administrator reserves the right at any time, at its sole discretion, to unilaterally make any changes to the User Agreement without any special notification to each individual User about the corresponding changes. The User independently bears all risks associated with untimely familiarization with the current version of the User Agreement before starting each use of the Service.

2. Terms and definitions

In the User Agreement, unless explicitly stated otherwise, the terms are used in the following meanings:

2.1. Service Administrator — VIVOSOUND, a legal entity established and operating in accordance with the legislation, which has rights in relation to the domain name www.vivosound.com as well as other rights in relation to the Service (including exclusive rights to the relevant intellectual property objects), and the controlling person operating the Service within the limits established by law and this User Agreement (both independently and with the involvement of third parties).

2.2 User an individual or a representative of a legal entity who has started using any page of the Service (including by visiting the Service in order to review and study it) regardless of the purpose and duration of such use, as well as regardless of completing Registration on the Service and having an Account.

2.4. Registration is a procedure in which the User provides the Service Administrator with information about themselves using the approved registration form for further use of the Service through their Account.

Service — a set of intellectual property objects, including computer programs and databases, as well as other objects accessible via the Internet information and telecommunications network using the VIVOSOUND domain name, the right to use which is granted to Users under the terms of the User Agreement.

2.6. An Account is a part of the Service intended for use after the User has registered on the VIVOSOUND Service in the Internet information and telecommunications network and entered the username and password assigned to the User during Registration.

2.7. Free access  — is the right to use the Service granted by the Service Administrator to a User who has not registered on the Service and/or does not have an Account, the scope of which is determined based on the specific functionality of the Service that exists at a specific time and is available without the User using his Account.

2.8. VIVOSOUND Service credits — the User’s right to demand that the Service provide a certain service to the User outside the Service in a non — virtual space, which has a limited validity period specified in this Agreement or directly in the Service, for example, to organize the performance of a specific musical work within a certain institution — a third party — on the territory of the Service’s operations, provided in exchange for payment made by the User under this Agreement.

2.9. User Content — information and data sent by the User via the Internet directly to the Service, including specific actions performed by the User through the use of the Service, including the selection of relevant musical or other works offered by the Service, as well as sending any other information to the Service or through the Service.

3. Rights and obligations of the User

3.1. The User has the right to use the Service within the limits and under the conditions established by the User Agreement, including posting or indicating User Content on the Service through the available functionality of the Service.
